Harb stated in a statement: “Abdul-Mahdi continues with his government to conduct matters even for a year until the handover of the new government, as there is no vacancy for the President of the Republic to assume the position of Prime Minister according to Article 81 of the Constitution, as freedom is achieved with the death of the resigned Prime Minister or his illness that prevents him from performing his duties or His abduction or absence, and intentionally not attending the official working hours, such as sitting at home or traveling and leaving Iraq, or having a physical objection to prevent him from performing his duties as normal conditions.
He added: “In this case, the President of the Republic fulfills the duties of the Prime Minister and we have in the previous year 2010, where Maliki remained in office for seven months after the end of the four years and the election of a new parliament.
The President of the Republic did not assume the position of Prime Minister because the required vacancy in Article 81 of the Constitution was not achieved despite Abdul-Mahdi did not complete the four years specified constitutionally for his government, and he who resigned and was not sacked by Parliament, as he did not withdraw confidence from him, as there is no constitutional scope for the President of the Republic to assume the position of Prime Minister, because the vacancy was not achieved.
The constitutional context, according to the requirements of Article 76 of the Constitution, obligates the political blocs in Parliament to present their nominees, provided that the mandate comes from the President of the Republic.
